The Process
There are three parts to a child support case: 1 - determining initial support, 2 - enforcing a child support order, and 3 - modifying an existing order to meet changing needs and circumstances. No matter where you are at in your child support case, we can help.
Initial child support. Upon separating from your spouse as well as among unmarried parents, all children are entitled to financial support from both parents until the age of 18 or until graduation from high school. Illinois guidelines will automatically set forth the amount needed based on the gross income of you and your spouse.
Child support enforcement. Sometimes a party ordered to pay a certain amount of child support by the court fails to pay the required amount or is constantly late with their payments. If this is the case, a court can find that party in contempt forcing him or her to pay or serve jail time.
Child support modification. An increase or decrease in the amount one party pays in child support may need modification due to a change in circumstances. Loss of a job, reduced work hours, or disability are just some examples when the court may need to modify child support payments.
