Illinois divorce law is guided by the Illinois Marriage and Dissolution of Marriage Act (IMDMA). The law contains residency requirements for divorce, mandating that at least one of the spouses be a resident of the state for at least 90 days. It also specifies that divorce will only be granted upon the finding that irreconcilable differences have caused the marriage to break down to the point that it cannot be repaired. If the parties are not in agreement regarding the breakdown of the marriage, a separation of six months or longer will be considered by the court as irrefutable proof of irreconcilable differences.

The IMDMA prevents the Court from issuing a divorce judgment unless appropriate considerations have been made regarding the division of property, spousal support, allocation of parental responsibilities, and child support. In certain situations, judgment may be reserved for one or more of these areas, but all must be expressly addressed if applicable.
